TERMS OF SERVICE
These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly and made available online, through any mobile device, by email, or by telephone. By accessing, browsing, and using our (mobile) website or any of our applications through whatever platform and/or by completing a reservation, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below (including the privacy statement). These pages, the content, and infrastructure of these pages and the online reservation service (including the facilitation of payment service) provided by us on these pages and through the website are owned, operated, and provided by Oasis by the Bay Vacation Suites and are subject to the terms and conditions set out below.
BOOKINGS & DEPOSIT
All bookings and reservations at Oasis by the Bay are subject to these terms.
A deposit (the “Deposit”) of one (1) night’s room rate will be charged per room at the time of booking to secure your reservation. The Deposit shall be made by Master Card or Visa credit card.
We shall also have the right to require full payment for your entire reservation in advance in certain circumstances, in our sole discretion, acting reasonably. No booking shall be treated as confirmed by you until you receive written confirmation thereof from Oasis by the Bay.
Note: You acknowledge and agree that the minimum age for booking and check-ins is 21 years of age. By booking a reservation with us and checking in, you represent and warrant that you are 21 years of age or older.
PAYMENT
We accept the following methods of payment for the balance of your reservation (see Deposit payment details above): cash, MasterCard, or Visa credit card.
For advance booking rates the card you booked with may be required to be presented on arrival, along with valid photo identification.
Note: Effective September 5, 2014, Oasis by the Bay is no longer required to charge HST on rooms or excursions as we are a registered charity.
Price lists, if any, for additional items, such as specialty bookings, events or tour services, are available on request.
CHECK-IN/ CHECK-OUT REQUIREMENTS
In the interests of security and to prevent fraud, at the time of check-in, guests may be required to confirm their identity by providing their booking reference; their photo identification; and a valid credit card. The information above may be requested for each member of your party over the age of 16 and we reserve the right to refuse entry to persons who cannot provide the information set out above.
Unless otherwise stated on the booking confirmation, guests may check-in at any time from 3:00 p.m. on the scheduled day of arrival. All rooms that have been secured by credit/debit card or prepaid at the time of booking will he held until 11:59pm on the scheduled day of arrival unless otherwise agreed directly with Oasis by the Bay.
On the day of departure, we kindly ask all guests to vacate their rooms by 11:00 am (unless a later departure is stated as part of your booking). Late check-out after this time can be requested subject to availability. If your room has not been booked by a subsequent guest, checkout may be extended until 12:00 p.m. at no additional charge to you, in the discretion of Oasis by the Bay. Any checkout later than 12:00 p.m. will be charged at an hourly rate at the discretion of Oasis by the You’re your room key may be left at our office or in your room in the event of an early check out.
Rooms are subject to maximum occupancy rules set by Oasis by the Bay. If you would like further details, please contact us.
CHARGES
The prices displayed on our website are an average rate on a per night per person basis until a rate is selected. A minimum length of stay, special Deposit, cancellation charge and other special conditions may apply to certain rates, as specified. Once a rate is selected on the website, the total for your requested stay shall be displayed on the reservation summary. Prices shall be charged in the local currency of Oasis by the Bay and any currency conversion facility, if provided, is an approximation tool only.
The maximum stay with us at Oasis by the Bay shall be thirty (30) consecutive days and you covenant to peaceably vacate our premises at the conclusion of your reservation.
LIMITED HOURS
Oasis by the Bay typically operates our front desk for 6 hours per day from 11am to 5pm during peak season. Our hours may be reduced from time to time depending on the time of year, occupancy of the motel, and weather. We reserve the right to close any facilities due to weather conditions, staffing requirements, or for Health and Safety reasons without prior notice. Availability of all amenities are dependent on a seasonal schedule and weather.
PAYMENT
We accept the following methods of payment: credit cards: American Express, MasterCard, Visa. For advance purchase rates the card you booked with may be required to be presented on arrival, along with an appropriate ID. At the time of reservation we will charge the equivalent of your first night’s accommodation rate + HST. At that time you will also be charged for any confirmed add-on services or tickets on the reservation. Seven days prior to your reservation arrival date, we will charge the remaining balance of your accommodation/outstanding services to your credit card on file.
CHANGES OR CANCELLATION BY GUEST
All cancellations of reservations or bookings by you shall be made at least seventy-two (72) hours prior to 6:00 p.m. of your scheduled arrival date. If you cancel your reservation or booking in accordance with the preceding sentence, you will be entitled to a refund of your Deposit in full. However, you acknowledge and agree that your Deposit will be forfeited if you cancel your reservation or booking within seventy-two (72) hours of 6:00 p.m. on your scheduled arrival date. If you fail to show up for your booking or reservation and have not given us notice of cancellation, your Deposit will be forfeited, and you expressly authorize us to charge your credit card for the full amount of your reservation or booking. Notwithstanding anything herein to the contrary, cancellations shall not be permitted for “long weekends” (in these terms and conditions this shall be construed to mean weekends on which a statutory holiday falls on either the Friday preceding such weekend or the Monday immediately following such weekend) and you expressly authorize Oasis by the Bay to charge your credit card for the full amount of your booking or reservation.
CHANGES OR CANCELLATION BY Oasis by the Bay Vacation Suites
Very occasionally we may need to cancel your booking. In such circumstances you will be given a full refund, but we shall have no further liability to you arising out of such cancellation.
If your booking is for a specific room and in the same room for the duration of your stay, we will use our reasonable efforts to honour your room selection. However, we may need to allocate an alternative room to you for operational or safety reasons. If we need to move you to a different room during your booking for which a lower rate is available than the rate you booked at, we will refund you the difference in the rates.
DAMAGE
We reserve the right and you hereby expressly authorize us to charge your credit card for any damage incurred to your room or the Oasis by the Bay property during your stay (including without limitation specialist cleaning) or for any items that are missing when you leave, determined in our sole discretion, acting reasonably and in good faith.
PARKING
Oasis by the Bay has on site designated parking for guests staying with us. On or before arrival, you shall provide the make, model, and license plate of any vehicle parking in our lot overnight. We are not able to offer any parking whatsoever (day or night) for any guests not staying with us. Any vehicles not registered with us may be towed at the owner’s sole expense and without notice.
All vehicles and their contents are at your sole risk. We do not accept responsibility for loss or damage however caused, and you expressly assume all such responsibility.
GUEST BEHAVIOR
Guests are not allowed overnight, and you may only bring two (2) or fewer guests to our property per day per room booked. All guests are requested to always conduct themselves appropriately and to comply with these terms and conditions, our procedures and/or requests with regard to conduct and respect for the property of Oasis by the Bay, its employees and guests and their health and safety. Guests shall not disrupt the comfort and enjoyment of other guests, the operating of Oasis by the Bay, or cause offense to other guests or our members of staff. You expressly assume responsibility and liability for your guests and any damages caused by them whatsoever. We reserve the right to refuse accommodation or Services or to remove you and members of your party from our premises if, in our reasonable opinion, we consider this provision to have been breached. Where this is the case we shall have no obligation to refund you for lost accommodation, other services or any other loss or expense incurred, and you expressly release us from any claims you may have against us for the foregoing whatsoever.
NO SMOKING, VAPING OR PARTIES
Smoking and vaping of any substance is not permitted in our guest suites, employee work areas or within nine (9) meters of any door of Oasis by the Bay or on any of our three patios. Any evidence of the breach of this policy may result in a reasonable cleaning fee determined in our sole discretion and you hereby expressly authorize us to charge your credit card for the same without notice to you.
You may not host any parties or play music that is unduly loud at any time during our stay with us, and you agree to indemnify us for all damages and reasonably legal fees incurred due to any breach of the foregoing.
ADULT SUPERVISION
All individuals under 21 years of age must be accompanied and supervised by an adult over the age of 21 at all times.
PETS, EMOTIONAL SUPPORT & SERVICE ANIMALS
Oasis by the Bay welcomes one (1) well-behaved dog weighing under eighty (80) pounds in Suites 1, 2, 3, 9, 10, and 11 only for an additional nightly fee of $25.00, due on check-in. This fee is non-refundable. This fee shall not apply to guide or service dogs. Therapy pets shall be accompanied by a letter from a licensed medical practitioner in order to avoid the foregoing fee. You shall and agree to produce up-to-date vaccination records for your pet on check-in, failing which we reserve the right to refuse entry to your pet. Any evidence of damage whatsoever to your suite will result in a reasonable cleaning fee determined in our sole discretion, and you expressly authorize us to charge your credit card for the foregoing. You acknowledge that hotel management may inspect your guest suite upon checkout to determine whether any damage has occurred. Your pet may not be left unattended in your guest suite. All pets must comply with all applicable laws and regulations and insurance liability requirements. Pets must be on controlled leashes at all times when not inside your guest suite. Pet owners shall only walk their pet in designated pet area(s) on our grounds on leashes, and shall pick-up and dispute of pet waste at all times. If hotel management receives more than two (2) complaints with respect to your pet, we shall be entitled to require you to make alternative arrangements for your pet or to vacate our premises, without refund.
We do not offer any pet sitting services. We are unable to accept cats or any other animals such as birds or reptiles at our premises.
NO DISCRIMINATION
It is the policy of Oasis by the Bay to not discriminate on the grounds of sex, race, colour, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, or sexual orientation. We believe that we have a duty to our guests and staff or employees to protect them from inappropriate behaviour. Guests shall adhere to this policy, and you expressly agree that we may, without incurring any liability to you whatsoever, immediately remove from the property any person(s) breaching this policy. Should any actions by you or any authorized guest or member of your party be deemed inappropriate by us, or if any inappropriate behavior is brought to the attention of us, we reserve the right, after any allegations have been investigated, to take all appropriate action.
FORCE MAJEURE
Oasis by the Bay accepts no liability and will not pay any compensation whatsoever where the performance of our obligations is impaired or affected, directly or indirectly, by or as a result of a force majeure event or any circumstances beyond our reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.
LIMITATION OF LIABILITY
YOU AGREE THAT OASIS BY THE BAY SHALL NOT BE RESPONSIBLE FOR ANY PERSONAL INJURY SUFFERED BY YOU ON OUR PROPERTY, NO MATTER HOW THE SAME IS CAUSED, OR FOR ANY LOSS OR DAMAGE TO YOUR PERSONAL PROPERTY WHILE YOU ARE STAYING WITH US, AND YOU EXPRESSLY WAIVE AND FOREVER RELEASE AND DISCHARGE US WITH RESPECT TO ANY CLAIMS YOU MAY HAVE IN THE FUTURE AGAINST US WITH RESPECT TO THE FOREGOING.
OASIS BY THE BAY SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL OR PURE ECONOMIC LOSS OR ANY LOSS OF PROFIT, GOODWILL OR OPPORTUNITY (WHETHER CAUSED BY THE NEGLIGENCE OF OASIS BY THE BAY, ITS EMPLOYEES, CONTRACTORS OR AGENTS OR OTHERWISE). YOU ACKNOWLEDGE AND AGREE THAT OUR TOTAL LIABILITY SHALL BE STRICTLY LIMITED TO VALUE OF THE CHARGES PAID BY YOU FOR YOUR RESERVATION.
GOVERNING LAW AND JURISDICTION
These terms and conditions are governed by the laws of the Province of Ontario and the courts of such Province have the exclusive jurisdiction to determine any dispute arising in connection with these terms and conditions and your receipt of Services, including disputes relating to any non-contractual obligations.
Each party irrevocably waives any objection which it may now or later have to proceedings being brought in the Ontario courts (on the grounds that the Ontario courts are not a convenient forum or otherwise).
WAIVER
WAIVER
Our failure at any time to require performance of any provision of these terms and conditions or to exercise any right provided for herein will not be deemed a waiver of such provision or such right. All waivers must be in writing. Unless the written waiver contains an express statement to the contrary, no waiver by us of any breach of any provision of these terms and conditions or of any right provided for herein will be construed as a waiver of any continuing or succeeding breach of such provision, a waiver of the provision itself, or a waiver of any right under these terms and conditions.
WEB SITE INFORMATION
While all reasonable efforts have been taken to ensure the accuracy of information on the websites, Oasis by the Bay Vacation Suites does not accept responsibility for errors or omissions and reserve the right to amend, cancel or vary any of the arrangements featured on the websites without notice. Please note that in certain circumstances, generic photographic images have been used to represent the general style of a particular product or Oasis by the Bay Vacation Suites. The content of the websites is the copyright of Oasis by the Bay Vacation Suites, and may not be copied, reproduced, published, distributed or amended for any other purpose without our prior written consent. Trademarks used on the websites are the property of the respective owners. Hyperlinks to third party websites are provided for your convenience. We cannot accept responsibility for the content or use of third-party sites that are not websites operated by Oasis by the Bay Vacation Suites.
PRIVACY POLICY:
This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.oasisbythebay.ca (the “Site”).
PERSONAL INFORMATION WE COLLECT
When you visit the Site, we may automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we may collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site.
